Lawmakers in the State Senate have passed a bill that will bring more uniform sentencing guidelines for second degree murder.
In March, the State Supreme Court ruled a sentencing for a second-degree murder case was unconstitutional, which gave the Senate a 120-day window to redefine the state law.
Senate Bill 1400, will do two things: the first is set a sentencing guideline of 10 to 35 years if a defendant meets certain criteria of minimal culpability. The second, will establish a life without parole option, if the jury determines the defendant caused the death of the victim.
Those already in prison for second degree murder would also be eligible for parole if they have completed 35 years on incarceration or 20 years and are age 70 or above.
The bill passed with bipartisan support in the Senate (30-20) and has been introduced in the House Judiciary Committee.
