The judge overseeing the case involving the death of a 15-year-old boy in Butler Township has recused himself.
Visiting Judge Christopher St. John recused himself following a motion from the Butler County District Attorney.
41-year-old Joshua Rivera is accused of hitting and killing 15-year-old Aiden Lutz with his vehicle in October 2023.
The motion from the DA’s office came after St. John said he didn’t feel the case would rise to third-degree homicide, which are the charges Rivera is facing.
The recusal will most likely delay the trial, which was scheduled to start in September.
