A Butler man convicted of a marijuana offense has filed a federal lawsuit in attempt to obtain an open carry license.
The suit filed last week asks the courts to allow 56-year-old Craig Philips to obtain an open carry license after a Supreme Court ruling decided that being convicted of marijuana possession cannot bar someone from the second amendment rights.
In 1994 Philips was convicted of being in possession of a personal use amount of marijuana. Philips has passed background checks to use guns and claims he hasn’t used marijuana in over 30 years.
The lawsuit names Pennsylvania State Police Commissioner Lt. George Bivens and Butler County Sheriff Mike Slupe.
The goal of the lawsuit is to allow those with similar charges to no longer bar anyone else from having an open carry license.
